Procedural Posture

Criminal Revision / Ruling on Application for Revision of Sentence

  1. 1 Whether the applicant was lawfully sentenced to the Kamiti Youth Correctional and Training Centre despite being above the statutory age limit.
  2. 2 Whether the sentence imposed by the trial court was erroneous and should be revised.

Ratio Decidendi

The court found that the applicant was 22 years old at the time of sentencing, as evidenced by his National Identity Card indicating a birth year of 1996. Section 67 of the Prisons Act restricts committal to a youth corrective training centre to persons who have attained the age of 17 but not yet 21. The trial magistrate erred by sentencing the applicant to such an institution. The High Court, exercising its revisionary jurisdiction under Sections 362 and 363 of the Criminal Procedure Code, set aside the sentence as unlawful and substituted it with a sentence of the term already served, ordering the applicant's immediate release unless otherwise lawfully held.

Court Disposition

sentence set aside and substituted with term served; applicant to be released unless otherwise lawfully held

Orders

  • The sentence committing the applicant to Kamiti Youth Correctional and Training Centre is set aside.
  • The applicant's sentence is reduced to the term already served.
