While the claimant admitted to leaving his post without permission, which constituted a valid reason for dismissal under section 44(4)(a) of the Employment Act, the respondent failed to follow the mandatory procedural requirements of section 41 by not giving the claimant an opportunity to be heard or to make representations before termination. This procedural lapse rendered the dismissal unfair within the meaning of section 45 of the Act.
