Although the lease in question was a controlled tenancy, both parties agreed that the tenant had vacated the premises before the reference was filed. As a result, the landlord-tenant relationship had been extinguished, and the tribunal no longer had jurisdiction to entertain the matter. Any outstanding disputes, such as rent arrears, had mutated into a commercial dispute to be determined by the appropriate forum, not the tribunal.
