Ratio Decidendi

The Court found that the Plaintiff is the registered proprietor of the suit land and that the caveat/caution registered by the 1st Defendant was inhibiting the Plaintiff's ability to transact with the property. The caveat was registered under the repealed Registration of Titles Act, and the applicable law is therefore the RTA. The 1st Defendant, despite being duly served, failed to appear or show cause why the caveat should not be removed. The Court determined that the entry in the title indicating a 1970 registration was erroneous, as the leasehold interest only commenced in 1992. The continued maintenance of the caveat was found to be unreasonable and prejudicial to the Plaintiff....
