The court found that although the plaintiffs had not taken any steps to prosecute the suit and the defendant had made repeated efforts to set the matter down for hearing, the application for dismissal was premature. This was because the last step in the proceedings occurred on 3 November 2010, and the application for dismissal was filed on 21 April 2011, less than one year later. Order 17 Rule 2 requires that a period of one year must lapse without any step being taken before a suit can be dismissed for want of prosecution.
