The court found that the application for stay of execution was filed without unreasonable delay, as it was made just over a month after the impugned judgment. However, the applicant failed to demonstrate that he would suffer substantial loss if the stay was not granted, as there was no evidence that the respondent would be unable to refund the decretal sum should the appeal succeed. Nonetheless, the applicant offered to furnish a bank guarantee as security for due performance. In the interest of justice and to allow the appellant an opportunity to prosecute the appeal, the court exercised its discretion to grant a conditional stay of execution, requiring partial payment to the respondent...
