Procedural Posture

Criminal Revision / Ruling on Application for Sentence Review

  1. 1 Whether the High Court has jurisdiction to review or alter a sentence imposed by the Court of Appeal.
  2. 2 Whether the applicant's sentence should run from the date of arrest rather than the date of conviction as ordered by the Court of Appeal.

Ratio Decidendi

The High Court dismissed the application on the ground that it lacks jurisdiction to review or alter the sentence imposed by the Court of Appeal. The issues raised by the applicant regarding the commencement date of his sentence had already been determined by the Court of Appeal in his own appeal, where the appellate court expressly ordered that the 30-year sentence was to run from the date of conviction, not from the date of arrest. The High Court is bound by the decision of the Court of Appeal and cannot revisit or overturn its orders. Accordingly, the application was dismissed for want of jurisdiction.
