The court held that Order 9 Rule 9 of the Civil Procedure Rules does not require a new advocate to seek leave to come on record in an appeal file where they did not act at trial, as the appeal is a separate proceeding. The applications seeking leave for change of advocates and to expunge the appeal documents were therefore misconceived and dismissed. On the application for stay of execution, the court found that the appellant had not delayed in bringing the application, had demonstrated risk of substantial loss if execution proceeded (including the risk to tools of trade), and had offered to provide security. The respondent had not shown ability to refund the decretal sum if the appeal...
