The Court of Appeal held that the appellants' cause of action, based on alleged medical negligence, accrued on 29th August 2008, the date of the deceased's death. The appellants were aware of the material facts, including the cause of death, as early as February 2010 when they obtained a post-mortem report. It was not necessary for them to await the outcome of the Medical Practitioners and Dentists Board's proceedings before instituting their claim in court. The limitation period under Section 4(2) of the Limitation of Actions Act therefore expired on 28th August 2011. The suit filed on 19th December 2013 was thus time-barred.
