The court held that while employees retain the right to file individual claims, this right must be exercised in accordance with due process to avoid multiplicity of suits. The Claimants, having been listed as grievants in Cause No.433 of 2015 by their union KALPA, could not simply withdraw from that suit by writing to the Deputy Registrar. Proper procedure requires that KALPA, as the party to the earlier suit, move the court for withdrawal or amendment to remove the Claimants as grievants. Filing the current suit while the earlier suit subsists amounts to a multiplicity of suits, which is an abuse of court process.
