Procedural Posture

Land and Property Suit / Judgment

  1. 1 Whether the plaintiff was the lawful allottee of the suit land and entitled to its possession.
  2. 2 Whether the subsequent allocation and registration of the suit land to the 2nd and 3rd defendants, and transfer to the 1st defendant, was fraudulent, illegal, irregular and void.
  3. 3 Whether the 1st defendant acquired any valid title as an innocent purchaser for value without notice.

Court Disposition

Plaintiff's suit succeeds against all defendants except for the claim for general damages, which is denied.

Orders

  • The 1st defendant shall vacate all portions of the suit land or be evicted therefrom; a permanent injunction restrains the 1st defendant and his agents from entering, developing, occupying, or interfering with the plaintiff's possession and use of the suit land.
  • It is declared that the preparation of lease documents by the 4th defendant in favour of the 2nd and 3rd defendants, and subsequent registration and issuance of lease certificate by the 5th defendant, was fraudulent, illegal, irregular, and null and void.
