Evidence showed the late Makhanu Chemiati, father to both plaintiff and defendants, was the actual shareholder and owner of the disputed land. Receipts for payments were issued in the father's name as late as 2005, and the plaintiff's share certificate was only issued in 2006. The court accepted that the land was rightfully subdivided among the four sons following local arbitration, and that all children of the deceased were entitled to a share.
