Procedural Posture

Employment Appeal / Judgment

  1. 1 Whether the appellant was subjected to due process before dismissal.
  2. 2 Whether the respondent had valid reasons for the appellant's dismissal.
  3. 3 Whether the dismissal was fair and justified under the Employment Act Cap 226.

Ratio Decidendi

The court found that while the respondent had a valid reason to dismiss the appellant for sleeping on duty, the failure to accord the appellant a hearing before the staff management committee constituted a breach of the principles of natural justice and due process as required by law. The absence of a proper hearing rendered the dismissal unfair and unjustified, notwithstanding the existence of a valid substantive reason. The court therefore set aside the lower court's decision and awarded the appellant compensation equivalent to 12 months' salary, plus costs.
