The court found that both the Kanduyi Lands Disputes Tribunal and the Western Province Land Appeals Tribunal acted outside their statutory jurisdiction by purporting to determine and award title to land. The Land Disputes Tribunals Act limited their jurisdiction to issues of boundaries, occupation, and trespass, not ownership or title. As such, their decisions and any consequential actions, including changes to the land register and issuance of titles, were null and void. The appeal was allowed, the tribunal awards and all resulting entries in the land register were quashed, and the Land Registrar was directed to reinstate the register to its status prior to the impugned tribunal orders.
