Procedural Posture

Civil Appeal / Ruling on Application for Review of Previous Ruling and Order

  1. 1 Whether there was an error apparent on the face of the record in the ruling and order made on 7th August, 2013.
  2. 2 Whether the court should review and set aside the ruling and order made on 7th August, 2013.
  3. 3 Whether the appellants required leave of the court before filing the appeal from the Magistrate's Court.

Ratio Decidendi

The court found that although there was a reference to the wrong application in the ruling dated 7th August, 2013, the record showed that the application actually under consideration was the one dated 10th January, 2008, which sought the striking out of the appeal for lack of leave. The court concluded that there was no error apparent on the face of the record that would warrant a review of the ruling and order. The application for review was therefore dismissed for lack of merit, as the applicant failed to demonstrate a clear and self-evident error that could be corrected by review rather than appeal.

Court Disposition

application dismissed with costs

Orders

  • The application for review and setting aside of the ruling and order made on 7th August, 2013 is dismissed with costs.
