Ratio Decidendi

The court held that the reference to arbitration by Justice Osiemo was not made under the Land Disputes Tribunal Act but under Order 45 of the Civil Procedure Rules, as the dispute involved issues of trust and succession which are outside the jurisdiction of the Land Disputes Tribunal. The tribunal erred in treating the matter as if it fell within its statutory jurisdiction and further erred by filing the award in the subordinate court while the High Court suit was still pending. As a result, both the award of the Land Disputes Tribunal and the decision of the Provincial Appeals Committee were nullities. The parties must revert to the High Court suit for further recourse.
