Procedural Posture

Notice of Motion / Ruling on Application to Withdraw Previous Application and Reinstate Suit

  1. 1 Whether the plaintiff can withdraw his previous application and reinstate a suit that was previously withdrawn.
  2. 2 Whether the court has jurisdiction to reinstate a suit once it has been marked as withdrawn under Order 25 of the Civil Procedure Rules, 2010.
  3. 3 Whether the existence of double allocation and unresolved title issues justifies reinstatement of the withdrawn suit.

Ratio Decidendi

The court held that once a suit is marked as withdrawn under Order 25 of the Civil Procedure Rules, 2010, it ceases to exist and the court lacks jurisdiction to reinstate it. The law does not provide for reinstatement of a withdrawn suit; instead, a party wishing to pursue the matter must file a fresh action. The plaintiff's application to withdraw his previous application and reinstate the suit was therefore without legal basis, regardless of the alleged double allocation or unresolved title issues. The absence of opposition from the defendants did not alter the legal position. Accordingly, the application was dismissed with no order as to costs.
