Ratio Decidendi

The court found that while the application for stay was filed without unreasonable delay, the appellant failed to demonstrate the substantial loss he would suffer if the order was denied. The mere fact of losing possession of premises as a result of execution does not, by itself, amount to substantial loss. Since the appellant did not show he would be unable to secure alternative premises or that the loss was irreparable, the threshold for granting stay was not met. Consequently, the court declined to consider the issue of security for due performance and dismissed the application for stay of execution.
