Ratio Decidendi

The court found that the entire prosecution was conducted by unqualified persons, specifically police constables, contrary to the requirements of Section 85(2) as read with Section 88 of the Criminal Procedure Code. This defect rendered the proceedings null and void. The court quashed the conviction and set aside the sentence. Considering the seriousness of the offence, the availability of witnesses, the fact that the appellant had not served a substantial part of the sentence, and that the appellant did not oppose a retrial, the court exercised its discretion to order a retrial. The appellant was to remain in custody and be produced before the trial court for plea.
