Ratio Decidendi

The court found that the respondent failed to prove valid reasons for the claimant's dismissal and did not accord him a fair hearing as required by Section 41 of the Employment Act 2007 and Article 50(1) of the Constitution. The purported verbal warning was not acknowledged by the claimant and thus insufficient. The employment contract did not expressly consolidate house allowance into the salary, entitling the claimant to separate house allowance. The dismissal was therefore unlawful and unjustified. The claimant was entitled to one month's salary in lieu of notice, house allowance for eight months at 15% of salary, and twelve months' salary as damages for unlawful termination.
