Ratio Decidendi

The Plaintiffs failed to establish a prima facie case as they did not provide evidence of title to the suit properties or demonstrate that the properties are subdivisions of the original parcel L.R. No. Kajiado/Kaputiei-North 3931. The mutation forms provided related only to two of the suit properties and did not establish the necessary link. Without such evidence, the court could not grant injunctive orders. Furthermore, the court found that any loss suffered by the Plaintiffs could be adequately compensated by damages, and thus the requirement of irreparable harm was not met. The application for a temporary injunction was therefore denied.
