Procedural Posture

Miscellaneous Application / Interlocutory Application Ruling

  1. 1 Whether the applicant has established a proper basis for a mandatory order compelling the respondent to release his motor vehicles from the NTSA portal.
  2. 2 Whether the tribunal has jurisdiction to order restructuring of the applicant's loan.
  3. 3 Who should bear the costs of the application.

Ratio Decidendi

The tribunal found that the applicant had not established special circumstances to warrant the grant of a mandatory injunction compelling the respondent to release the motor vehicles from the NTSA portal. The applicant remains indebted to the respondent, and the respondent has a first charge over all his registered motor vehicles as security for the outstanding loan. The tribunal further held that it does not have jurisdiction to restructure the loan or rewrite contracts between the parties, especially at the interlocutory stage. The application was therefore dismissed for lack of merit, with costs in the cause.
