Ratio Decidendi

The court found that the appellant died on 6th December, 2012 and the applicant, his spouse, obtained a grant of letters of administration on 25th May, 2014. However, the application for substitution was filed more than two years after the appellant's death, outside the twelve-month period prescribed by law. The application for substitution did not include a prayer for revival of the abated appeal. As a result, the appeal had abated by operation of law, and there was no competent appeal before the court to be reinstated. The court therefore dismissed the application for reinstatement with costs, holding that without an application for revival, reinstatement was not possible.
