Ratio Decidendi

The court held that the South Kinangop Land Disputes Tribunal acted outside its statutory jurisdiction by awarding one acre of land to the interested party, as its powers under section 3 of the Land Disputes Tribunal Act No. 18 of 1990 are limited to boundary disputes and claims to occupy or work land, not to matters of title or sale. The Tribunal's decision was therefore ultra vires and null and void. The court further found that only affidavits filed with the application for leave could be relied upon, and struck out any additional affidavits not properly before the court.
