Procedural Posture

Succession Cause / Judgment

  1. 1 Whether the deceased died testate or intestate.
  2. 2 How the estate of the deceased should be distributed among the beneficiaries.

Ratio Decidendi

The court found that the deceased died intestate, as acknowledged by the protestors in their own cross-petition and by their failure to produce any valid will. The court held that, in the absence of a valid will and given the disagreement among the beneficiaries, the estate must be distributed according to the intestacy provisions of the Law of Succession Act. Section 38 of the Act mandates equal distribution among surviving children where there is no spouse. The court rejected the protestors' proposals based on a non-existent will and confirmed the grant as prayed by the petitioner, ordering equal division of all assets among the four sons.

Court Disposition

Summons for confirmation of grant allowed; estate to be distributed equally among the deceased's children; each party to bear own costs.
