The court found that although the sentence imposed on the applicant was excessive and illegal for the offence of failing to prevent a felony (a misdemeanour), this alone did not warrant the grant of bail pending appeal. The court determined that the appeal would be heard expeditiously and that there was no risk of the applicant serving a substantive part of the sentence before the appeal was determined. The court was not satisfied that the appeal had overwhelming chances of success, and the grounds advanced by the applicant were more appropriately ventilated in the appeal itself rather than as a basis for bail.
