The preliminary objection raised by the Defendants had been overtaken by events following the adoption of the Land Registrar and Surveyor's report as a court order. With no defence on record and no reasonable explanation for their absence, the Defendants failed to establish a reasonable case for vacating the orders of 2nd October, 2019 or for re-opening the Plaintiffs. case. The court therefore dismissed the application as lacking merit and awarded costs to the Plaintiffs.
