Procedural Posture

Dismissal Application / Ruling on Application to Dismiss Suit

  1. 1 Whether a suit instituted by an advocate without a valid practicing certificate is invalid and should be dismissed.
  2. 2 Whether the documents filed by such an advocate can be invalidated.

Ratio Decidendi

The court held that although the advocate who filed the suit did not have a valid practicing certificate at the time, he was otherwise a qualified advocate. The Supreme Court's decision in National Bank of Kenya Ltd vs. Anaj Warehousing Ltd clarified that documents and proceedings are not automatically invalidated solely because the advocate lacked a practicing certificate. To do so would undermine constitutional protections, including the right to property and fair hearing. Therefore, the application to dismiss the suit on this ground was not merited and was dismissed with costs to the respondent.
