Ratio Decidendi

The court found that the facts presented by the prosecution did not clearly establish whether the applicant was in possession, was a dealer, or knew and failed to report the whereabouts of the trophies, thus casting doubt on whether any offence was disclosed against the applicant. This uncertainty led the court to conclude that the appeal had overwhelming chances of success. Consequently, there was no justification for depriving the applicant of his freedom pending the determination of the appeal. The court therefore granted bail pending appeal, subject to the applicant executing a bond and appearing at all required court dates.
