Criminal Appeal / Judgment

  1. 1 Whether the sentence of 25 years imprisonment imposed for defilement of a child under 11 years was lawful under Section 8(2) of the Sexual Offences Act.
  2. 2 Whether the appeal against sentence should be allowed or the sentence enhanced to comply with the law.

Ratio Decidendi

The trial court erred in imposing a sentence of 25 years imprisonment for defilement of a child under 11 years, as Section 8(2) of the Sexual Offences Act mandates a sentence of life imprisonment for such an offence. The appellate court is bound by statute to correct the illegal sentence, regardless of the appellant's plea for leniency. The appellant, having taken advantage of a very young and vulnerable child, must be sentenced in accordance with the law to protect other children and serve as a deterrent. The appeal against sentence is dismissed, the illegal sentence is set aside, and the appellant is sentenced to life imprisonment as required by law.
