Ratio Decidendi

The court found that since both parties agreed that the matter had been overtaken by events and no benefit would be derived from continuing, the dispute was effectively at an end. The plaintiff, by agreeing to compromise and not proceed, was essentially withdrawing the suit. In such circumstances, it is unusual and not merited for the party abandoning the claim to seek costs. The court exercised its discretion under Section 27 of the Civil Procedure Act and ordered that the suit be marked as compromised with no orders as to costs.
