Ratio Decidendi

The court found that while the applicant committed a heinous and brutal murder, he is a first offender who has been in custody since December 2012 and has shown remorse and reformation. In line with the Supreme Court's decision in Muruatetu, which grants courts discretion in sentencing for murder, the court determined that a life sentence or the death penalty was not mandatory. Considering the applicant's mitigation and the current sentencing trends, the court substituted the death sentence with a custodial sentence of 30 years, effective from the date of initial custody.
