Ratio Decidendi

The tribunal found that the tenant did not issue a valid notice to terminate the tenancy as required by the agreement, nor was there evidence that the landlord closed room B or prevented the tenant's access in a manner that would justify non-payment of rent. The landlord's notice to terminate tenancy was properly served and took effect on February 1, 2022. The tenant remained liable for rent arrears up to the date of delivery of vacant possession. The tenant is entitled to collect his property from the premises upon payment of arrears, failing which the landlord may sell the property to defray the debt. Costs are awarded to the landlord as the successful party.
