The court held that the claimant's dismissal, effected after two warnings within twelve months and without issuance of a written notice of termination, constituted a summary dismissal under section 44(1) of the Employment Act, 2007. The court found that warnings, while establishing a pattern of misconduct, do not substitute for the statutory or contractual requirement of notice. Clause A5(b) of the Collective Bargaining Agreement merely expands the grounds for summary dismissal but does not negate the statutory right to pay in lieu of notice.
