Furthermore, the trial court failed to formally convict the appellant before proceeding to sentence, contrary to established procedure. These procedural lapses rendered the conviction and sentence unlawful. The court relied on the principles set out in Adan v R (1973) E.A 445 regarding proper plea taking and held that the appellant was serving an unlawful sentence.
