The court found that the petition for a limited grant of letters of administration had merit because the purpose was to enable substitution in a concluded land dispute case (Murang’a LDT Case No 131 of 2006) where a decree had already been issued and was awaiting execution. The opposition raised by the 1st Respondent was based on a different case (LDT Case No 16 of 2007) and was therefore irrelevant to the present petition. The court noted that there was no pending trial in the relevant case and that the decree was not time-barred.
