The High Court found that although a suit filed in a court without jurisdiction is a nullity and cannot be transferred, the present case was distinguishable because the lower court had jurisdiction at the time of filing. The subsequent joinder of the Registrar of Societies, a party whose disputes are statutorily referred to the High Court, changed the substratum of the case and deprived the subordinate court of jurisdiction. Therefore, the High Court had the power to transfer the suit under section 18 of the Civil Procedure Act.
