Since the respondent/applicant did not file a counterclaim for the alleged outstanding loan, it is not entitled to deduct the loan amount from the judgment sum. Regarding statutory deductions, the employer is entitled to deduct and remit PAYE to the Kenya Revenue Authority, but must provide proof of such remittance to the claimant.
