Miscellaneous Application / Ruling on Application for Bail Pending Appeal

  1. 1 Whether the High Court has jurisdiction to grant bail pending appeal where the notice of appeal was filed under the wrong provision.
  2. 2 Whether the application for bail pending appeal is merited in the circumstances.
  3. 3 Whether the applicant's actions amount to an abuse of court process.

Ratio Decidendi

The High Court lacks jurisdiction to grant bail pending appeal where the notice of appeal has been filed under the wrong provision of law, as there is no properly constituted appeal pending before the Court of Appeal. The application is further undermined by the applicant's simultaneous pursuit of similar relief before the Court of Appeal, amounting to an abuse of court process. Additionally, the Court of Appeal has already directed that the appeal be heard on a priority basis, negating the risk of the applicant serving his sentence before the appeal is determined. Consequently, the application is fatally flawed and without merit.
