Ratio Decidendi

The court found that the replying affidavit of the interested party introduced, for the first time, the issue of parcel No. 1940 as the correct subject of the proceedings, which constituted a new matter within the meaning of Order LIII Rule 4(2) of the Civil Procedure Rules. The ex parte applicants were therefore entitled to amend their statement of facts and file a further verifying affidavit to address this new matter. The opposition by the interested party was rejected as unfounded, and the court granted the orders sought in prayer (a) of the Notice of Motion dated 5th December 2008. Costs were ordered to be in the cause.
