Procedural Posture

Land and Property Dispute / Judgment

  1. 1 Whether the defendant holds a portion of the suit property in trust for the plaintiff.
  2. 2 Whether the plaintiff is entitled to half share of the suit property or only a portion corresponding to his father's entitlement under the 1943 agreement.
  3. 3 Whether the defendant's evidence regarding redemption of the property is consistent with his pleadings.

Ratio Decidendi

The court found that the defendant deviated from his pleadings by introducing evidence inconsistent with his original claim without amending his pleadings as required by law. The evidence did not sufficiently prove that the plaintiff's father held the suit property in trust for the defendant. The court held that, since there was only one parcel of land and no evidence that the plaintiff's father held the property on behalf of the defendant, the defendant holds half share of the suit property in trust for the plaintiff. The plaintiff's claim was therefore merited and allowed as prayed.

Court Disposition

Plaintiff's claim allowed as prayed.

Orders
