The court found that, since Central Imenti District has no court, a party may file a suit in the nearest court, which could be Tigania, Nkubu, or Meru. Thus, Tigania Court had territorial jurisdiction. On pecuniary jurisdiction, the applicant failed to provide evidence that the value of the subject matter exceeded the jurisdiction of the Tigania court, and the burden of proof lay with the applicant. Therefore, the trial court had both territorial and pecuniary jurisdiction.
