The court found that it had erred in marking the matter as closed on 10th February 2020 while the Defendant's application to set aside judgment was still pending and directions had been given for parties to comply with Order 11 of the Civil Procedure Rules. The Defendant was entitled to have its application heard on merit, and the closure of the case was premature. The court therefore set aside the closure order, revived the Defendant's application, and directed that the Plaintiffs should not dispose of or transfer the suit property pending the hearing and determination of the suit.
