Ratio Decidendi

The court found that despite exhaustive efforts, both the original court file and police file could not be traced. While the loss of such files is not in itself a bar to ordering a retrial, the appellant had already served seven years of an eighteen-year consecutive sentence. Given the slim prospects of recovering the files and the time already served, the court determined that the sentence already served was sufficient and that a retrial was unnecessary. The appellant was therefore ordered to be released unless otherwise lawfully held.
