Ratio Decidendi

The High Court held that it cannot transfer a suit from a subordinate court to itself if the subordinate court lacked jurisdiction to entertain the matter in the first place. The applicants admitted that the value of the subject property exceeded the pecuniary jurisdiction of the Chief Magistrate's Court, rendering the proceedings there incompetent and a nullity. Furthermore, the lower court file had been closed by consent after revocation of the grant, and the applicants ceased to be petitioners, thus lacking locus standi. There was no existing suit capable of being transferred. The application to transfer was therefore dismissed as misconceived and an abuse of the court process.
