Ratio Decidendi

The court found that the applicants' counsel, R.A. Ochuru & Co. Advocates, had not obtained the necessary leave of court to come on record after judgment had been entered, as required by Order 9 Rule 9 of the Civil Procedure Rules, 2010. This procedural defect was fatal to the application, and as such, the court could not address the substantive prayers for review or setting aside of the judgment. The court held that the application was an abuse of court process and accordingly struck it out with costs to the respondent.
