The Court found that the applicant, having been convicted of a capital offence and sentenced to death, should be afforded the opportunity to appeal. The delay was explained as being due to lack of proper legal counsel, and the Republic did not oppose the application. Furthermore, the applicant's co-accused had previously been granted an extension of time to appeal in similar circumstances. In the interests of justice and to ensure parity of treatment, the Court exercised its discretion to extend the time for lodging the notice of appeal and deemed the notice already filed as properly filed within time.
