The court found that the Claimant’s termination was unfair as the Respondent failed to provide a valid reason or follow due process, including giving notice or a hearing as required by the Employment Act. The Claimant was replaced without justification, and the Respondent did not account for the full period of NSSF contributions. The Claimant was therefore entitled to one month’s wages in lieu of notice, annual leave pay for five years, compensation for unfair termination equivalent to twelve months’ wages, and service pay less the amount already available under NSSF. The claim for public holiday pay was rejected due to lack of specificity and supporting evidence.
