Ratio Decidendi

The court found that the lower court did not err in adopting the award of the Land Disputes Tribunal, as the award clearly specified the acreage to be allocated to each respondent and had already been made a judgment of the lower court at the appellant's own instance. The decree based on that award had never been set aside, and the subsequent appeal to the Provincial Land Disputes Appeals Committee did not alter the original award. The lower court's ruling simply re-adopted the original tribunal award and authorized execution of the decree. The appellant's grounds of appeal were therefore misconceived, and the appeal was dismissed with costs to the respondents.
