The subsequent location of the file was not an afterthought, and the defendant had not demonstrated any prejudice that would result from reopening the case. However, to prevent undue delay or the introduction of extraneous issues, the court limited the reopening strictly to the production of the final order or judgment and the certificate of confirmation of grant from the succession proceedings, to be produced by an appropriate officer from the Eldoret High Court registry.
